NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR DONATION OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.1. Eligibility: “You’ve Been Conned” giveaway is open only to legal residents of 48 contiguous United States, and who are at least eighteen (18) years old. The immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members of Angela Serocki, whether related or not, are not eligible to participate in this Giveaway. This Giveaway is subject to all applicable federal, state, and local laws and regulations. Void outside the contiguous United States. Participation in this Giveaway constitutes entrant’s full and unconditional agreement to these Official Rules and B.W. Inc.’s and Administrator’s decisions, which are final and binding in all matters related to this Giveaway. Winning the prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Giveaway begins on April 27, 2010 at 12:00 a.m. Central Time (“CT”) and ends on September 30, 2010 at 11:59 p.m. CT (the “Promotion Period”). Angela Serocki’s computer is the official time-keeping device for this Giveaway.

4. How to Enter: During the Promotion Period, there are two (2) ways to enter:

4.1) Website Method of Entry: Visit http://youvebeenconned.tatepublishing.net/ and follow the and instructions to complete and submit the registration form in its entirety by email at [email protected]. During the registration, you are asked to provide certain information, including but not limited to your first and last names, One (1) phone number, your date of birth, your email address, a valid home address located within one (1) of the eligible states. Upon submitting your complete registration form, you automatically will receive one (1) entry into the Giveaway. Only one (1) entry will be accepted per individual.

4.2) Mail-In Method of Entry: Mail a 3″x5″ piece of paper with your first and last names, Two (2) phone numbers, your email address, date of birth and a valid home address in an envelope with proper postage to: Angela Serocki, 5522 570th Street, Beardsley MN 56211″. All entries must be postmarked at least 10 days prior to the Giveaway end date and received by the Giveaway end date. You will receive one (1) entry into the Giveaway. Limit: One (1) entry per individual.

For All Entry Methods: Limit: Participants may enter the Giveaway one (1) time, regardless of the method of entry, during the Promotion Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using the same/multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be void. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player and he/she must comply with these Official Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. All mail-in entries must be handwritten. All entries become the exclusive property of Angela Serocki., and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Angela Serocki. Angela Serocki is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified.

5. Grand Prize Drawing: Angela Serocki, whose decisions as to the administration and operation of the Giveaway and the selection of the potential winner are final and binding in all matters related to the Giveaway. B.W. Inc will randomly select the potential Giveaway winner from all eligible entries received during the Promotion Period, on or around October 1, 2010. The potential winner will be notified by mail, email or phone. If the potential winner cannot be contacted, within the required time period, (10 days) potential winner will be disqualified and the prize forfeited. Potential winner must be at least eighteen (18) years of age and will be responsible for complying with all requirements imposed on winner set forth herein. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that the potential winner is disqualified for these reasons or any other reason, Angela Serocki will award the applicable prize to an alternate winner selected by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held. If the prize has not been successfully awarded to an eligible winner after three alternate drawings, the prize will not be awarded.

6. Prize: ONE (1) GRAND PRIZE: You’ve Been Conned Defying Depression by the Grace of God, paperback book by Author Angela Serocki

Approximate Retail Value of the prize: $10.99. Prize is non-transferable and no substitution or cash equivalent is allowed. Odds of winning the prize depend on the number of eligible entries received during the Promotion Period.

Release: By participating in the Giveaway, entrant agrees to release and hold harmless Angela Serocki and any other agency that provides services in connection with this Giveaway, and each of their respective officers, directors, employees, representatives, contractors and agents and successors and assigns (collectively, the “Released Parties”) from and against any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Giveaway, or their participation in the Giveaway, or their participation in any Giveaway or prize-related activity, or any travel related to the Giveaway or any travel for any prize-related activity. Winner also further acknowledges that Angela Serocki, its affiliates, subsidiaries, employees, officers, directors, and promotions and advertising agencies have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize or the Giveaway EXCEPT AS SET FORTH IN SECTION 6.

8. Publicity: Except where prohibited, participation in the Giveaway constitutes winner’s consent to Angela Serocki and its designees use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional, publicity, public relations and advertising purposes in any manner in any and all media now or hereafter known worldwide in perpetuity, without payment, consideration, permission or notification.

9. General Conditions: Angela SErocki reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by Angela Serocki in its sole discretion. If terminated, Angela Serocki may, at its sole discretion, randomly select winner from among all eligible, non-suspect entries received up to time of such action. Angela Serocki reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Angela Serocki reserves the right to seek damages from any such person to the fullest extent permitted by law. Any failure by Angela Serocki to enforce any term of these Official Rules or any applicable laws shall not constitute a waiver of such right. If any provision of these Official Rules is found by a court of competent jurisdiction to be invalid, then entrant, B.W. Inc and the court shall endeavor to give effect to the intent reflected in that provision, and the remaining Official Rules shall retain their full force and effect.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, typographical, printing or other errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, Internet connections, or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) any error or problem of any kind which may occur in connection with or relating to this Giveaway, whether technical, network, mechanical, typographical, printing, human or otherwise, including, without limitation, any errors or problem which may occur in connection with the administration of the Giveaway or the processing of entries or the announcement of the prize or in any Giveaway-related materials; (5) late, lost, garbled, delayed, misdirected, inaccurate, incomplete, undeliverable, damaged or stolen entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. IF FOR ANY REASON AN ENTRANT’S ENTRY IS CONFIRMED TO HAVE BEEN ERRONEOUSLY DELETED, LOST, OR OTHERWISE DESTROYED OR CORRUPTED, ENTRANT’S SOLE REMEDY IS ANOTHER ENTRY IN THE GIVEAWAY, PROVIDED THAT IF IT IS NOT POSSIBLE TO AWARD ANOTHER ENTRY DUE TO DISCONTINUANCE OF THE GIVEAWAY, OR ANY PART OF IT, FOR ANY REASON, Angela Serocki, IN ITS SOLE DISCRETION, MAY ELECT TO HOLD A RANDOM DRAWING FROM AMONG ALL ELIGIBLE ENTRIES RECEIVED UP TO THE DATE OF DISCONTINUANCE FOR ANY OR ALL OF THE PRIZES OFFERED HEREIN. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Angela Serocki reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action. (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, and in no event shall entrant be entitled to receive attorneys’ fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Angela Serocki in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.

12. Entrant’s Personal Information: Information collected from entrants is subject to Angela Serocki Privacy Policy, and will not be shared with any other agencies. Entrant agrees that Angela Serocki has the right to contact Entrant with other offers, correspondence, or information that Angela Serocki feels may be of interest to Entrant.
